TV TODAY NETWORK LIMITED (“TVTN”) is undertaking a contest Jan Sansad, an online Voting Based contest.(“Contest”). This Contest is subject to the following terms & conditions (“Terms & Conditions”). If any of the participant(s) does not agree with these Terms & Conditions, such participant(s) is advised not to participate in the Contest and TVTN shall have no liability towards such participant(s) in any manner whatsoever. Participation or submission of entry shall be deemed acceptance of the Terms & Conditions by such participant(s). TVTN reserves the right in its sole and absolute discretion to amend/change/vary/terminate all or any of the terms and condition for the Contest or terminate the Contest at any time without giving any prior notice. By entering into the Contest, the participant(s) agrees to such terms as amended from time to time. TVTN is not obligated in any manner whatsoever to compensate any person or persons who have participated in the Contest.

For the purposes of these Terms & Conditions, wherever the context so requires, "You" or "Your" shall mean any natural person who is a eligible participant in the Contest in accordance with the Terms & Conditions and the “Company”, TVTN “Us”, “We” and/ or “Our” shall mean TV Today Network Limited, a company registered under the Companies Act, 1956 having its registered office at F-26, First Floor, Connaught Place, New Delhi– 110001, India.

Name and Duration of the Contest: _ Jan Sansad; 22nd April 2019 to 22nd May _2019

The Contest shall be hosted on the web, mWeb and app of Aaj Tak-only. The Contest will be commencing on 22nd April 2019 (00:00 hours) Indian Standard Time (“IST”) and shall end on 22nd May 2019(23:59) IST on the web, mWeb of Aaj Tak_.TVTN may at its sole discretion extend or limit the period of the Contest without any prior intimation.

TVTN has the right to amend (add, delete or modify) the Terms and Condition governing the Contest, prospectively or retrospectively, at its discretion and without prior notice.

The following terms and conditions (“T&Cs”/ “Terms and Conditions”) shall be applicable to TVTN contest to be conducted on its web page - https://aajtak.in/jannsansad by TVTN and shall be termed as follows: Jan Sansad Contest on Twitter, Facebook, Instagram and Whatsapp.

The above contest shall be referred to with its Contest title on the Twitter and Facebook pages which is owned by the TVTN.

Following are the terms that shall be applicable to the Contest:

I. ELIGIBILITY

1. The Contest is open only to Indian citizens, residing in India. Citizens and/or residents of countries other than India are not eligible to participate. Citizens and/or residents of countries other than India residing in India are not eligible to participate.
2. The Participants must be adults having attained the age of eighteen (18) years to participate in the Contest as on the date of the Contest. (All persons fulfilling conditions mentioned in this section shall be hereinafter referred to as “Participants”. By participating in the Contest, you (“Participant”) signify your assent to these Terms and Conditions stated below).
3. Employees of TVTN, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and their respective household members of TVTN, its affiliates, subsidiaries, and divisions, advertising and promotion agencies, and all others associated with the design, execution, production, development, and promotion of this Contest or are connected to this contest in any way are not eligible to participate in the Contest.
4. The participant(s) undertake, warrant and guarantee to TVTN that the participant(s) has the full legal capacity to participate in the Contest in accordance with these Terms & Conditions.
5. By participating in the Contest, each Participant agrees to follow these Terms and Conditions and is deemed bound by any decisions made by TVTN in its sole discretion, including any interpretations of the Terms and Conditions.

II. HOW TO PARTICIPATE

Contest shall be open for participation as per the timelines specified in the T&Cs

i. Eligible participant(s) need to follow the below rules:

1. 20 Winners would be chosen from all eligible participants. Top 20 Participants who get the maximum votes shall be announced as winners,
2. Sincere efforts will be made to follow the timelines. However, in the event of circumstances beyond the control of Management of TVTN, these timelines may need to be altered.
3. No Expense(s) shall be borne by TVTN, whatsoever.
4. Winners of the contest will be declared on the - App and social media pages or where ever TVTN exercises its choice including but not limited to Facebook, Instagram and Twitter etc. Further, management will make reasonable efforts to contact and intimate the winners based on the information given by the participants during the contest (email/SMS).
5. TVTN's selection of the winners will be final and binding on all participants.
6. No review or enquiry into the selection process of the winners will be entertained.
7. TVTN reserves all rights and discretion for selecting the winners.
8. Judging Criteria: Winners would be randomly chosen amongst the participants

2. The Participants shall be required to provide basic personal information about them including but not limited to Participants name, address, telephone number or mobile number and email address in order to register and participate in the Contest. The information provided by the Participants may be used by TVTN for internal purposes and to send in the future to the Participants promotional information pertaining to the TVTN.
3. 4. Method and time of declaration of winners The Winners shall be declared on 22nd May 2019 on TVTN’s Jan Sansad Website. TVTN may require Winners to provide valid photo identity documents including but not limited to passport , Aadhar Card etc,
5. TVTN reserves the right to disqualify any participant if it has reasonable grounds to believe that the Participant has breached any of these Terms and Conditions.
6. Participants shall make their profile and make their manifesto between 22nd April 2019 to 18th May 2019 . Participants shall thereafter seek votes through social media and whatsapp between 20th May 2019 -21st May 2019 __ If the Participant do not use the passport size front face photon their respective profile page then their profile may be removed by TVTN. Participants confirm that the pictures, views, idea of the manifesto uploaded by them or any part thereof do not infringe upon the statutory rights, common law rights, intellectual property rights including copyrights in literary, dramatic, musical or motion picture rights, patent rights or the trademark or trade names of any person, firm, corporation, association or entity whatsoever neither any part thereof shall violate the statutory rights of, or the right of privacy, or constitute a libel or slander against any person, firm, corporation, association or entity whatsoever, or violate any other rights not herein specifically enumerated. No pictures, views, idea of the manifesto or any part thereof shall be defamatory or contribute contempt of court or breach of contract, or breach of any provision of statute, nor hurt the sentiments of religious groups. In the event of any infringement and/or any unlawful usage of any information provided by the Participants, TVTN does not endorse the aforesaid and shall not be held liable on any account whatsoever.

III. LIABILITY/RESPONSIBILITY

1. Participants shall not post any profanity , abusive comments, illicit images and anti-national slogan, derogatory remarks in their respective manifesto video/text or profile image. In the event of any such profanity abusive comments, illicit images and anti-national slogan, derogatory remarks such Participants shall be disqualified forthwith and TVTN reserves its rights, in addition to removing such manifesto, to take a legal action against such participant.
2. TVTN including its divisions, affiliates and subsidiaries, and their respective agents and representatives, employees shall not be responsible for any loss of entries for any reason whatsoever including, due to any technical problems for entries received after the deadline as a consequence of computer service delays, interruptions, electronic failures or overloads, or for lost, misdirected or misplaced entries. The entries are void if unreadable, inaccurate, incomplete, damaged, tampered with, falsified, mechanically reproduced, not in prescribed format, irregular in any way or otherwise not in compliance with these Terms and Conditions.
3. TVTN makes no representations and disclaims all express, implied, and statutory warranties of any kind to the Participant and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, merchantability or fitness for any particular purpose.
4. Under no circumstance, unless due to wilful misconduct or gross negligence, shall TVTN and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever. The Participant specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against TVTN their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest.
5. By entering into the Contest, the Winners/Participants waive all copyrights including but not limited to Intellectual Property Rights (IPR) and moral rights, rights of publicity and any related rights and consents to TVTN’s right to use the pictures uploaded by the Participant(s) the captioned posted for the Contest , picture, tape or portray him/her as a Contest Winners, and to exhibit this material in any and all media now existing or hereinafter created, including without limitation television, film, radio and print media, without any compensation whatsoever for advertising and publicity purposes, except where prohibited by law. The Winners also consent to TVTN’s right to use his/her name, voice or picture, or the content of his/her Contest Entry (collectively, the “Publicity Rights”). TVTN can allow to its agencies to exercise/exploit the Publicity Rights in conjunction with TVTN.
6. Under no circumstances shall TVTN and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if TVTN has been advised of the possibility of such damages.
7. The Participant specifically agrees not to file in person/through any family member and/or any third party any Registrations, criminal and/or civil proceedings in any courts or forum in India against TVTN their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest.
8. The Participant agrees that he/she shall not hold TVTN and/or their employees, responsible for delays or any problem in connection to the Contest. TVTN is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Participants and/or the Participant in any manner whatsoever or for any reason whatsoever in connection to the Contest.
9. The content, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), all entries, are owned by TVTN.

IV. PRIZE

1. A As the winning prize, - all winners will be Invited to India Today Media Plex and will be felicitated; their story and interview will be covered on Aaj Tak Digital Media Only.
2. TVTN reserves its right to select and declare or not to declare the Winners in the Contest.
3. the Winner may be required to sign an “indemnity and release of claims” form provided by TVTN, as the case may be, which shall release TVTN of all liability.
4. Failure to complete and sign any documents requested by TVTN may result in disqualification and selection of an alternate Winner.
5. All decisions of TVTN are final in this regard. TVTN has the right to substitute the Prize, as determined by TVTN in its sole discretion.

V. OTHER TERMS AND CONDITIONS

1. a) TVTN is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Contest is provided "As is" without warranty of any kind.
2. b) TVTN does not make any commitment, express or implied, to respond to any feedback, suggestion and, or, queries of the Participants or furnish any reason or explanation for inclusion and, or, exclusion of any particular submission of the entry of a Participant at any stage of the Contest.
3. c) TVTN reserves the right to withdraw or discontinue and/or terminate the Contest at any stage without prior notice and without any liability whatsoever to the Participants. /The decisions of TVTN and its representatives shall be final and binding on all aspects of the Contest. Your participation in the Contest by posting the Entries will be deemed as an acceptance of the above stated Terms and Conditions.

The Contest and Terms & Conditions shall be governed by and construed in accordance with the applicable laws of India. Failure by TVTN to enforce any of these Terms & Conditions in any instance shall not be deemed to be a waiver of the Terms & Conditions and shall not give rise to any claim by any person. These Terms & Conditions are subject to Indian laws and the courts at New Delhi shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from.
